Nightingale Court gets its name from its location: Jenny Lind Grove.

"Jenny Lind" was an early 20th Century Swedish opera singer, known as the "Swedish Nightingale". She settled in Malvern and was a well-known local benefactor, having this road off Albert Park Road named after her. Today this quiet cul de sac in a lovely part of Malvern is in an area of many trees and just a stone's throw from the Malvern Link Common and in easy walking distance of the shops of Malvern Link and close to all the facilities of Great Malvern itself.

We purchased this site and then applied for a different planning permission. Instead of building 6 small apartments, we obtained planning consent for just 4 much larger apartments. We have built many apartments in the Malvern-Worcester area, as well as houses of all sizes.

BENEFITS OF THE MANAGEMENT COMPANY

Note: The following is a broad summary of what Court Property Developers does when it sells apartments.
This arrangment is highly beneficial to apartment owners.
The actual details will be contained in the lease and other legal documentation at the time of sale and may vary from this summary.
Check with your lawyer.
 

When the final apartment is sold, Court Property will form (at its cost) a managment company (Nightingale Court (Malvern) Ltd) and will give the freehold to the whole site to this company free of charge. Court Property will also open a bank account in the name of the new management company. All ground rent paid from that moment will be paid into that Company.Court Property will also set up initial insurance for the property.

This company will be solely owned by the apartment owners, who will each have one share per bedroom. The company will have a board of directors, and each partment owner is expected to be or to nominate a director. If the management company ceases to exist for any reason, the ferehold will revert to Court Property.

The management company will have the usual responsibities of management companies. That is, it will be responsible for: the structural fabric of the building;  the common areas (eg drive, parking areas, below ground drainage, rainwater gutters etc); arranging structural insurance; etc

Each apartment owner is responsible for: the maintenance of the landscape, paving etc which is in the amenity area allocated to that apartment; cleaning leaves etc out of the gulleys at the bottom of the rainwater down pipes in its amenity area; cleaning its own windows (most are easy-clean ie can be cleaned from inside); internal maintenance and decoration; insurance of their own contents; etc.

This gives major benefits to apartment owners.

*  the ground rent that all apartments pay goes to the management company and NOT to the developer

*  the capital value of the freehold stays with the apartment owners (developers often sell the freehold for a lump sum)

*  the running of the apartments stays solely with the apartment owners, rather than the freeholder. There are many reports of apartment owners paying extortionate sums to companies that have bought the freehold in order to make a profit from the freehold, eg through overcharging.

The above adds considerable value to these apartments.
